Please read and understand these Terms and Conditions. If you have any concerns or problems, please contact us before you make a booking or purchase a Gift Card, or upon receipt of your Gift Card or Booking Confirmation. Treat your ticket similar to that of any other Airline ticket as our Terms and Conditions are comparable to the rest of the Aviation Industry.
1. LIABILITY Under no circumstances will the supplier be liable for direct, indirect, consequential or incidental damages, including but not limited to lost or damaged property, lost profits or savings or damages or disappointment. You will be required to complete an indemnity form upon pick-up prior to flying. The supplier may arrange for your flight to be carried out by another balloon company. In such instances, the supplier accepts no liability in connection with such services or for any loss, injury, or damages to in respect to person or property. The supplier reserves the right to alter contents of product when deemed necessary.
2. ALTERATION & CANCELLATION OF A BOOKING In the unfortunate event you should have to alter or cancel your booking certain fees & conditions apply: No refunds will be given for cancellations less than 24 hours before the flight. Gift Vouchers are NON-REFUNDABLE after 30 days of the purchase date.
3. FAILURE TO SHOW You will be charged the full cost of your flight if you fail to show for your flight no matter what the reason. No refunds or flight rescheduling are allowed. Direct bookings - by providing your credit card details to secure your booking you are agreeing to these terms and conditions and allowing the supplier to charge your credit card in the event you fail to show. You may send someone else in your place if you wish. Please let us know the name of the replacement person before the flight. If you are unduly concerned about your ability to attend the flight, travel insurance is recommended (contact your Insurance Broker). NB: Separate cancellation and alteration provisions apply to large groups and customised events. These are specified on the group booking documentation supplied. The supplier reserves the right to amend these fees and notice periods. When special circumstances arise, some of these Terms and Conditions may be superseded by those published on your booking confirmation documentation or Gift Voucher.
4. GIFT CARDS Gift Cards are valid only when fully paid by the purchaser or distributor. Gift Cards cannot be redeemed for cash or refunded in part or full. Cards are transferable to other individuals with written permission of the card holder and are valid only for the period indicated thereon. Once the gift card has been redeemed (i.e. the flight date has been booked) all other terms relating to Alteration and Cancellation apply (refer full terms and conditions), however the value remains non-refundable. Your Gift Card is strictly valid until the Expiry Date shown on your Gift Card and you must fly within that period. Should you need to extend the validity beyond the expiry date, a 6 month extension is available at AUD$50 per person. No further extensions are permitted beyond this period. Please note that it may take several attempts to fly before a successful launch is achieved so Gift Card holders need to book well in advance of the expiry date. We do not fly pregnant ladies of 4 months or more, the disabled or people recovering from major operations. In this instance, vouchers are fully transferable.
5. FLIGHT DURATION Flight duration times are approximate only and may vary for safety, weather or suitable landing site reasons.
6. WEATHER, MECHANICAL, STAFFING & OTHER SAFETY CONDITIONS Hot air ballooning relies on suitable weather conditions in order to proceed safely. Additionally, flights may depend on mechanical performance or staffing availability. When conditions are deemed by the supplier to be unsuitable or unsafe to proceed, then the flight will be cancelled. Similarly a flight may be postponed due to less than minimum numbers being achieved. In the unfortunate event that a flight must be delayed, rescheduled or cancelled due to any factor, the supplier will hold payment and offer alternative dates. If you require a refund for a flight the supplier has cancelled, please contact the supplier's office within 12 months of the first booked date. Gift Vouchers are non-refundable. The supplier will not accept any liability for travel, accommodation, inconvenience or other cost incurred or lost through such cancellations.
7. REBOOKING YOUR FLIGHT If your flight has been cancelled due to inclement weather conditions, please contact our office as soon as possible to rebook. Payment received for your flight will be held in credit and applied to the rebooking. Rebooking must be done within 12 months of the first cancelled flight date. There will be no refunds for bookings held on our system for longer than 12 months. Being a weather dependant activity it may take several attempts to fly.
8. YOUR RESPONSIBILITIES (a) It is your responsibility to ensure that you have received booking confirmation details of your flight: please notify our office immediately and prior to your flight date if you do not have this information. You are required to follow our check-in procedures outlined on your Booking Confirmation prior to your flight. (b) In the interests of safety, you undertake to follow the instruction of the pilot and ground crew, comply with any local codes of conduct and act sensibly and prudently at all times. You also agree to indemnify the supplier, it's owners, officers and employees for all losses and/or damage arising from any act or default on your part or the part of a member of your party. Under no circumstances at any time during the supply of Services should you or a member of your party be under the influence of drugs or alcohol, nor should you take medication that could affect or impair your judgment at this time. (c) Check with your medical practitioner if you have a pre-existing medical condition that may be affected by the physical nature of hot air ballooning. You agree to indemnify the supplier, its owners, officers and employees against any incident related to your health occurring during or after the supply of the Services. General Health Physical fitness is not a requirement to enjoy a ballooning adventure but passengers must be able to climb up and in (there are foot holes) and stand for the duration of the flight (with secure high sides to lean on) as there are no seats in the basket. Civil Aviation Safety Authority (CASA) rules and regulations and the supplier's policy prevent us from flying women who are over 12 weeks pregnant. Pregnancy must be advised in advance. Sickness or diseases that may affect the person or other persons on the tour must be notified to the supplier in advance. Medication should be brought on the tour. Any form of disablement must be discussed with the supplier prior to making a booking. Each person is considered on an individual basis. The flight and carriage of any passenger will take place at the pilot's discretion.. (d) Personal belongings are taken at your own risk. (e) Ballooning is an outdoor adventure activity, the supplier cannot be held liable for damage to clothing.
9. INSURANCE We carry Air Carriers Liability Act Insurance up to AUD$725,000 per passenger and AUD$20,000,000 combined single limit legal liability.
10. ACCEPTANCE OF RISK We do require you to sign our Passenger Manifest before the flight. When you sign this, you are operating under Air Operators Certificate No C419915-01, issued by the Civil Aviation Safety Authority of Australia. A mandatory Civil Aviation Authority Insurance is not included in the price you have paid your agent. The insurance charge is $30 per person and is payable direct to the supplier on the morning of the tour.
